Based on the questions the judges asked in oral arguments in the case between the CFPB and PHH, it appears that the court intends to decide on whether the structure of only being able to remove of the CFPB's single director for cause violates the Constitution's separation of powers, and that that determination may be made separately regardless of how the court rules on PHH's RESPA issues.
