
Disparate Impact Takes a Hit in Ninth Circuit
The City of Los Angeles went after Wells Fargo alleging that the lender's business practices resulted in discriminatory outcomes because of race or color, without regard for a causal connection between its practices and the outcome. However, the U.S. Court of Appeals for the Ninth Circuit affirmed a lower court's ruling that the City must show that a policy or practice of the bank caused the disparity, not just that there was a disparity.
