The Fifth Circuit ruled, in a 2-1 decision, that the CFPB structure is constitutional. The majority ruled that the CFPB's single-director structure allowed for sufficient Executive Branch oversight. A dissenting opinion viewed the CFPB's structure as unconstitutional due to protection from Presidential oversight. [3/6/20]
